PETALING JAYA: PJ Utara MP Tony Pua has filed an affidavit challenging his 2015 travel ban, saying that he has not been called up by the police or charged in court with any offence.

"Around September 2015, I was summoned by the Royal Malaysian Police to their headquarters at Bukit Aman to give a statement as a witness. Ever since Sept 4, 2015 I have not been called up by the police or charged in court with any offence," said Pua.

The DAP national publicity secretary said he had filed the affidavit to challenge the Immigration director-general Datuk Seri Mustafa Ibrahim and the Government, adding that the D-G had filed an affidavit on Jan 15 stating the reasons for the ban.

In the affidavit, Mustafa said that the travel ban was issued following a July 15, 2015 letter from the Inspector-General of Police.

"I had received a letter from the Inspector-General of Police dated July 15, 2015 stating that the applicant (Pua) was being investigated for offences under Section 124B of the Penal Code for being involved in plans to overthrow the Government," said Mustafa.

He added that his department does not have a legal obligation to inform a person that they have been barred from leaving the country.

"I stress that the Immigration Department does not have a legal obligation to inform the applicant that they are being investigated by the police and have been barred from leaving Malaysia," said Mustafa.

In his application for a judicial review, Pua said he was prevented from leaving the country at KLIA 2 on July 22, last year.

He said he was supposed to go to Yogyakarta that day using his passport, which was valid until April 23, 2020.

Pua claimed that the decision was ineffective under the law as it was in contradiction with his legitimate rights to travel abroad using a valid passport.
